A) Knowledge and understanding of the fundamentals related to the development of legal science in medieval and modern times.
B) Knowledge and understanding of the fundamentals of the development of legal science in medieval and modern times.
C) Ability to apply knowledge and understanding gained in the analysis of the major transformations undergone by the legal systems in the historical period considered in order to critically evaluate current legal systems.


Although no formal prerequisites are required, the knowledge of the fundamental principles of Roman law are useful.


The course aims to present the fundamentals of the development of European legal science in the Lower Middle Ages and the modern age. Particular attention will be paid to the study of doctrinal and legal sources and the evolution of the scientific method from the School of Glossators. In particular, the course will cover the following topics:
- Irnerio, the Bologna school and its approach to Roman law
- Bolognese literary genres
- The science of canon law: Graziano and decretistica
- The Canonical Corpus Juris
- The Scuola del Commento e The ratio legis
- Legal humanism and criticism of Roman law
- Modern Giusnaturalism: Man and State
- Legal Enlightenment and its exponents
- General considerations on the process of codification
- The French Civil Code: a model to historicise

Teaching Methods

Lessons will be provided mainly in person, integrated with online strategies, in order to guarantee their fruition in an innovative and inclusive way.

Verification of learning

The evaluation will be based on an oral exam that covers the entire program carried out in class. (see course contents and syllabus). To pass the exam, the student must demonstrate a sufficient knowledge of the topics covered in class or the textbooks. The highest possible grade is 30\30. Any grade below 18 will be considered insufficient. A grade of 30/30 cum laude presupposes an excellent review of all the elements that will be evaluated.
The evaluation will be based on the following elements:
1) knowledge of the material
2) ability to judge
3) ability to express
Active participation in lectures and seminars by students who attend class will taken into account.


We recommend studying the following texts:
1) E. CORTESE, Le grandi linee della storia giuridica medievale, Il Cigno Galilei, Roma 2000 (o ristampe successive), limitatamente ai capitoli II, IV, V, VI e VII della seconda parte (pagine 251-397, saltando 274-295).
2) 2) I. BIROCCHI, Alla ricerca dell’ordine Fonti e cultura giuridica nell’età moderna, G. Giappichelli editore, Torino 2002 o ristampe successive (si studieranno soltanto il cap. I, i §§ da 1 a 3 del cap. IV, i §§ 1 e 2 e da 6 a 10 del cap. VII, l’epilogo).

Upon request, it is possible to get ready for the exam with a different textbooks.
