Objectives

A) Knowledge and understanding: the student will acquire the basic knowledge inherent in the system of agricultural law sources, the legal discipline of the agricultural enterprise, as well as the knowledge inherent in the regulation of agricultural and agro-industrial contracts.
B) Applying knowledge and understanding: the student will acquire the ability to apply, based on the principles of interpretation, the legal knowledge acquired and will provide analysis and solutions to questions and concrete cases concerning the agricoltural law.
C) Making judgments: the student, by identifying autonomously the legal discipline of the agricultural enterprise and the agricultural contracts, will be able to formulate appropriate judgments in the analysis and solution of legal questions and practical cases on the subject.
D) Communication skills: the student will acquire a learning method that will allow him to update and deepen the acquired knowledge in written and oral form.
E) Learning skills: the student will acquire a learning method that will allow him to update and deepen the acquired knowledge

Prerequisites

No formal prerequisites are envisaged, but basic knowledge of Private law and Commercial Law is strongly recommended.

Contents

1) Concept and definition of agricultural law. The sources of agricultural law: the division of competence among the EU institutions, the State and the Regions.
2) The agricultural enterprise and the agricultural entrepreneur.
2.1) The agricultural activities: the "agro-biological" criterion.
2.2) Agricultural activities by connection.
3) The qualifications of the agricultural entrepreneur: coltivatore direttoand imprenditore agricolo professionale.
4) Agricultural companies.
5) The agricultural firm.
6) Agricultural contracts: notion, classification and legal regulation.
7) Agro-industrial contracts: art. 62 of the d.lgs. n. 1/2012 (converted into l. n. 27/2012).
8) Agriculture, environmental protection and sustainable development.

Teaching Methods

The teaching will be delivered in presence, integrated and "augmented" with online strategies, in order to guarantee its use in an innovative and inclusive way.
The course is divided into frontal lessons (36 hours) on the topics indicated in the "Contents" section, in exercitation and seminars (12 hours), dedicated to the analysis of case law and practical cases.

Verification of learning

Oral examination - usually divided into three questions based on the topics indicated in the "Contents" section.
To pass the exam, the student must demonstrate that he has acquired knowledge of course contents, skills and abilities indicated in the "Objectives" section.

The examination is evaluated according to the following elements:
1) failure to pass the test: insufficient knowledge of the course contents, insufficient evaluation and argumentative skill;
2) 18 to 21: sufficient or just enough preparation; minimal knowledge of the institutes and the issues faced in the course; presence of gaps not particularly relevant;
3) 22 to 24: medium preparation characterized by no particular deepening; presence of gaps that can be filled in the continuation of the overall training path considered;
4) 25 to 27: good overall preparation although not particularly thorough; appropriated technical language and ability;
5) 28 to 30: very good or excellent preparation; accurated technical language and precise expressive ability;
6) 30 and praise: highest level on preparation, technical language, expressive and argumentative ability.

Attending students: the oral examination will focus on the topics covered in the course.Participation in seminars and exercises will be taken into account during the course attendance. Participation in exercises and practical cases exempts from the final examination for the corresponding part of the exam program, which will be indicated.

The exam can be prepared using, at the student's choice, one of the following texts:

Part Three: chapters 9 (pp. 335-424), 10 (except §§ 10.2.1; 10.2.2; 10.2.3: pp. 425- 429 and 443-495), 11 (except § 11.11: pp. 497-573).
b) A. GERMANÒ, Manuale di diritto agrario, Giappichelli, Torino, 2016, limited to the following chapters and paragraphs:
chapters I, II, III, IV, V, VI, VII (pp. 1-200);
chapter IX, relating to §§ 1-6-7-8-9-10-11-12 (pp. 241-247 and pp. 259-278);
chapter X, relative to §§ 1; 2, 3, 4, 5, 6, 7; 11 (pp. 279-297 and pp. 306-310);
chapter XI, relating to §§ 8-9 (pp. 331-341).

Attending students: materials that will be indicated during the course.

The use of an updated civil code is recommended. It is also recommended the knowledge of the main complementary legislation in relation to the topics covered by the course, and indicated during the course.
